Fair Usage and Data Speed Policies: All data plans offered by Bacon Mobile L.L.C. are subject to our Fair Usage Policy. High-Priority network access (QCI Priority routing assigned to premium tiers like Thick Cut Unlimited) ensures enhanced data throughput during peak tower congestion times, but actual speeds may vary based on local topography, real-time tower traffic, weather conditions, and handset hardware compatibility. Unlimited data tiers are intended for direct, personal device consumption. Mobile hotspot capabilities are strictly capped according to the specific parameters of your selected plan tier.

Bring your own device (BYOD) & Number porting disclaimer.

Device Eligibility & Number portability: To activate service on the Bacon Mobile network via the Bring your own device (BYOD) program, the consumers smartphone must be completely network unlocked, fully paid off, and hardware-compatible with nationwide GSMA carrier frequencies. Final eligibility validation rests solely on our backend IMEI database query. Phone number porting logistics are processed through national telecommunications routing clearinghouses. While most phone transfers are executed with zero service disruption, number releases remain subject to the compliance rules, accurate account numbers and valid transfer PINs provided by the customers losing carrier.

Regulatory and Tax Disclosures: Bacon Mobile L.L.C. is a registered corporate entity in the State of Arkansas. Wireless services, regulatory recovery fees and localized state/federal E911 taxes are calculated and collected dynamically at checkout based on the end-users verified billing ZIP code. Service pricing, multi-line bundle structures, and wholesale network configurations are subject to standard carrier regulatory updates without prior notification.

1. ACCEPTANCE OF TERMS

Welcome to Bacon Mobile LLC (“Company,” “we,” “us,” or “our”). By accessing our website located at BaconMobile.com (the “Site”) or purchasing any wireless telecommunications services, subscription plans, or hardware products (collectively, the “Services”), you (“User,” “customer,” or “you”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of the terms and conditions contained herein, you are expressly prohibited from using the Services and must discontinue use immediately.

2. DESCRIPTION OF SERVICES & INFRASTRUCTURE: Bacon Mobile LLC operates as a Mobile Virtual Network Operator (MVNO). We provide wireless voice, text, and data transmissions by utilizing wholesale network carrier allocations provisioned over the nationwide network infrastructure of AT&T (the “Underlying Carrier”). You acknowledge and agree that Bacon Mobile LLC is an independent corporate entity and is not an agent, partner, joint venture, or employee of the Underlying Carrier. All third-party trademarks, service marks, trade names, logos, and brand elements displayed on the Site are the exclusive intellectual property of their respective owners. Their display does not constitute an endorsement, sponsorship, or direct retail relationship between the Underlying Carrier and the Company.

3. FAIR USAGE & SERVICE LIMITATIONS: All wireless data plans offered by the Company are intended solely for reasonable, personal, non-commercial use on a single, compatible handset device. We reserve the right to monitor data usage, traffic patterns, and network connection protocols. If your data utilization or bandwidth consumption patterns indicate commercial server hosting, continuous automated data streaming, illegal tethering, or network abuse that negatively impacts the Underlying Carrier’s system stability, we reserve the right, at our sole discretion and without prior notice, to throttle data throughput speeds, reduce network priority tags (QCI values), or permanently terminate the active line of service. Wireless transmission coverage, speeds, and signal availability are not guaranteed. Services are subject to temporary disruptions due to localized tower congestion, topography, building construction, weather, and specific device hardware capabilities. Mobile Hotspot capabilities are strictly limited to the hard technical caps specified in your chosen service plan.

4. BRING YOUR OWN DEVICE (BYOD) POLICY: By participating in the Company's Bring Your Own Device program, you assume full legal and operational responsibility for ensuring that your smartphone is completely paid off, network-unlocked from your previous carrier, and hardware-compatible with nationwide GSMA frequencies. Final activation eligibility is contingent upon our background International Mobile Equipment Identity (IMEI) database query. The Company shall not be held liable for any service failures, activation delays, or hardware malfunctions resulting from a user attempting to activate an incompatible or carrier-locked device.

5. NUMBER PORTABILITY: Telephone number porting requests are processed through national telecommunications routing clearinghouses. By initiating a port-in request to Bacon Mobile LLC, you explicitly authorize us to act as your agent to contact your losing carrier and manage the transfer of your telephone number. You are solely responsible for providing accurate billing names, account numbers, and valid Transfer PINs. The Company is not responsible for service delays, line drops, or early termination fees assessed by your losing carrier during the porting window.

6. BILLING, RENEWALS, & FINANCING: All Services are billed securely upfront on a recurring 30-day subscription cycle. Failure to settle balance renewals on your designated billing anniversary date will result in the immediate automated suspension of cellular voice, text, and data routing capabilities. Hardware device financing choices integrated into our checkout infrastructure are processed and managed entirely by third-party financial institutions (including Klarna and Affirm). All credit assessments, monthly interest rates, financing installment contracts, and debt collection practices are governed exclusively by the terms, conditions, and privacy policies of those respective lending vendors. The Company assumes zero credit liability or collection governance for financed device hardware.

7. FEES, TAXES, & REGULATORY UPDATES: Total charges at checkout are calculated dynamically based on the user's verified billing ZIP code. Prices are subject to mandatory state and federal telecommunications taxes, local E911 emergency recovery fees, and universal service fund assessments. The Company reserves the right to adjust retail pricing, plan feature bundles, or background regulatory fee metrics at any time to align with macroeconomic shifts or Underlying Carrier rate revisions.

8. LIMITATION OF LIABILITY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BACON MOBILE LLC, ITS DIRECTORS, EMPLOYEES, OR WHOLSEALE ENABLERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) ANY DISRUPTIONS OR TOWER FAILURES OUTSIDE THE REASONABLE OPERATIONAL CONTROL OF THE COMPANY.

9. GOVERNING LAW: These Terms shall be governed, construed, and enforced in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any legal actions or proceedings arising directly out of these Terms shall be brought exclusively in the state or federal courts located in Benton County, Arkansas
